What is Delta-9 THC?

Delta-9 THC (tetrahydrocannabinol) is the primary psychoactive compound found in cannabis (marijuana). Is Delta-9 Legal?

Hemp-derived Delta-9 THC with less than 0.3% THC by dry weight is legal under the 2018 Farm Bill. This means certain edibles, tinctures, and products that stay within this limit are federally legal. Under Federal law, Delta-9 is illegal, but it is allowed in states that have legalized marijuana for medical or recreational use.

In Tennessee, Delta- 9 is legal only if it is derived from hemp and contains no more than 0.3% THC on a dry-weight basis, in compliance with the 2018 Farm Bill. Marijuana-derived Delta-9 is illegal in the state.

In Georgia, the law is similar – hemp-derived Delta-9 THC is legal as long as it stays under the 0.3% THC limit. However, marijuana-derived Delta-9 is illegal, except for registered medical marijuana patients who can access low-THC oil (no more than 5% THC).
